Current terms and conditions

(1) Gbase Ltd is not responsible for any loss of debts incurred through the use of this site.

(2) We will agree to refund the user’s subscription in any given month when Gbase selections return a loss. This will be calculated by continuous use of every Gbase selection in that calender month and based on a standard £1 stake for each race.

(3) All rights in connection with any use of the Gbase Site (including without limitation all intellectual property rights and goodwill attaching thereto) will remain vested at all times and for all purposes in Gbase (or its licensors), and any direct or indirect use by or on behalf of the Gbase Site or Gbase’s name permitted by the terms and conditions of this Agreement will operate for and to the sole benefit of Gbase (or its licensors, as appropriate).

(4) Either party may terminate this Agreement immediately on written notice at any time if the other party breaches this Agreement and the breach is not remedied within 7 days of written notice from the innocent party requiring remedy

(5) Neither party will be liable to the other for any incidental, special, indirect or consequential loss or damage (including without limitation any loss of revenue, business, data, profit, anticipated profit or goodwill) or interrupted communication, however caused, arising out of or in connection with this Agreement, save that nothing in this Agreement shall exclude or limit the liability of Gbase for damages caused by its fraudulent misrepresentation or for death or personal injury caused by its negligence.

(6) Link Partner will indemnify and keep indemnified Gbase (including for this purpose all subsidiaries and holding companies of Gbase Ltd and all other subsidiaries of such holding companies (as these terms are defined in section 736 of the Companies Act 1985)) against all actions, threats, proceedings, liabilities, losses, damage, costs (including reasonable legal costs) and expenses whatsoever which may be made against or incurred by Gbase arising under negligence or out of or in connection with any use by Link Partner of Gbase’s name pursuant to this Agreement or any other matter set out in this Agreement.

(7) Gbase Ltd makes no representation or warranty about the content, accuracy or availability of the Gbase Site.

(8) This Agreement constitutes the entire agreement and understanding between the parties

(9) Nothing in this letter agreement will constitute, or be deemed to constitute, a partnership, joint venture, employment, representative or agency relationship between the parties.

(10) This Agreement will be governed by and construed in accordance with English law, and both parties agree to submit to the non-exclusive jurisdiction of the English Courts.
